The fkosoft.com software products ("Services") are made available to you by Ruzicka a syn s.r.o. ("fkosoft.com") and are subject to the following Terms of Service ("Terms"). Ruzicka a syn s.r.o. may also offer other services and products under diferent terms of service.

fkosoft.com may modify these terms and conditions at any time. The last operative revision will be available on this website.

Communications with fkosoft.com

The use of our Services may require certain communications from and to fkosoft.com, such as service announcements, administrative messages and newsletters. These communications may be considered as part of using the Services and are confidential.

Fees, payments and taxes

fkosoft.com reserves the right to modify the prices at any time, however modified fees shall not be charged unless your agreement to pay such charges is obtained. If you choose not to pay such modified fees, fkosoft.com has the right to stop providing Services to you.

In addition to all other terms and conditions of these Terms, you shall not:

  5. take any acction that imposes, or may impose at our sole discretion an unreasonalbe or disproportionately large load on our infrastructure,
  6. upload invalid data, viruses, wormd, trojan horses, or other harmful or disruptive codes, components, devices, or software agents through the Services,
  7. impersonate another person or otherwise misrepresent your affiliation with a person or entity, conducts fraud, hide or attempt to hide your identity, or misrepresent the source or content of information transmitted through the Services,
  8. use the Services in any unlawful manner or in any other manner that could damage, disable, overburden or impair the fkosoft.com website or all or any portion of the Services,
  9. bypass the measures fkosoft.com may use to prevent or restrict access to the Services,
  10. use any robot, spider, scraper, script, or other comparable automated technology to access the Services for any purpose without fkosoft.com’s express written permissions,

    1. notify fkosoft.com immediately of any unauthorized use of any password or fkosoft.com Account or any other known or suspected breach of security
    2. report to fkosoft.com immediately and use reasonable efforts to stop immediately any copying or distribution of content that is known or suspected by you or other Subscribers to violate these Terms or the intellectual property rights of third parties; and
    3. not impersonate another Subscriber or provide false identity information to gain access to or use the Services.

Spamming and illegal activities

You agree to be solely responsible for the contents of your transmissions to our Services. You agree not to use our Services for illegal, unlawful, harassing, invasive, abusive and threating purposes. fkosoft.com reserves the right immediately terminate your access to our services, if illegal or unauthorized activity is detected.

Intellectual property rights

fkosoft.com, both the work and mark, and the logos are trademarks of fkosoft.com. You agree not to display or use, in any manner, the fkosoft.com trademarks without prior written consent.

Disclaimer of warranties

YOU EXPRESSLY UNTERSTAND, ACKNOWLEDGE AND AGREE THAT THE USE OF THE SERVICES IS AT YOUR SOLE RISK AND LIABILITY. THE SERVICES ARE PROVIDED ON AS-IS-AND-AS-AVAILABLE BASIS. fkosoft.com EXPRESSLY DISKLAIMS ANY AND ALL WARRENTIES OF ANY KIND, WHERHER EXPRESS OR IMPLIED, INCLUDINGN, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. fkosoft.com MAKES NOT WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR VIRUS FREE. USE OF ANY MATERIALS DOWNLOADED OR OBTAINED THROUGH USER OF OUR SERVICES SHALL BE AT YOUR OWN DISCRETION AND RISK AN YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, MOBILE PHONE, WIRELESS DEVICE OR DATA THAT RESULTS FROM THE USE OF THE SERVICES OR FROM DOWNLOAD OF ANY SUCH MATERIALS. Limitation of liability

YOU AGREE THAT fkosoft.com SHALL, IN NO EVENT, BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR OTHER LOSS OR DAMAGE WHATSOEVER OR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, COMPUTER FAILURE, LOSS OF BUSINESS INFORMATION, OR OTHER LOSS ARISING OUT OF OR CAUSED BY YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF fkosoft.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH fkosoft.com RELATED TO ANY OF THE SERVICES SHALL BE TERMINATION OF SUCH SERVICES. IN NO EVENT SHALL fkosoft.com LIABILITY TO YOU, WHETHER DIRECT OR INDIRECT, EXCEED THE FEES ACTUALLY PAID BY YOU TO fkosoft.com FOR SUCH SERVICES IN THE THREE (3) MONTHS IMMEDIATELY PRECEEDING THE EVENTS GIVING RISE TO THE CLAIM. YOU AGREE THAT THE FOREGOING IS AN AGREED ALLOCATION OF RISK AND IS A REFLECTION OF THE RIGHTS AND OBLIGATIONS AGREED UPON BY YOU AND fkosoft.com IN THESE TERMS.

Indemnification

You agree to indemnify and hold harmless fkosoft.com, its directors, employees, suppliers and affiliates, from and agains any losses, damages, fines and expenses (including attorney's fees and costs) arising out of or relation to any claims that you have used the Services in violation of another party's rights, in violation of any law, in violation of any provision of the Terms or in connection with any other claim related to your use of the Services.

Termination

You agree that fkosoft.com may terminate your fkosoft.com account and access to the Services for reasons including, but not be limited to, breaches or violation fo these Terms or the fkosoft.com Privacy policy, a request by you to terminate your fkosoft.com account, discontinuance or material modification of the Services, unexpected technical issues or problems, extended periods of inactivity and/or requests by law enforcement or other gomernment agencies. Termination of your fkosoft.com account includes elimination of access to the Service, deletion of your fkosoft.com account information such as your email, id, and password and the deletion of data in your fkosoft.com account as permitted or required by law.

Severability

Each clause contained in these Terms and conditions shall be separate and severable from each of the others. If any clause is found to be void, invalid or unenforceable for any reason whatsoever, the remaining clauses shall remain in full force and effect.
